Director prohibitions issued in March 2026

In March 2026, the Companies Office prohibited 7 people from being directors or from being involved in the management of companies under section 385 of the Companies Act 1993, following a series of company failures.

The Registrar was satisfied that mismanagement contributed to the failures of the companies concerned. Across the cases, unpaid debts to creditors totalled just over $6 million, including amounts owed to Inland Revenue, with several liquidations resulting in limited or no recoveries for unsecured creditors.

Section 385 is a protective and forward‑looking provision that allows the Registrar to restrict company management where a company has failed and the way it was managed contributed to that failure. The provision supports appropriate standards of company management and helps protect the public and creditors.
